Welcome to Handy.Markets, a service provided by Handy.Markets (\"we,\" \"us,\" or \"our\"). These Terms of Use (\"Terms\") govern your access to and use of our website, Handy.Markets (the \"Website\"), and our mobile and desktop applications (collectively, the \"Service\"). The Service allows you to track prices of financial instruments, set up notifications, participate in financial events, and, for corporate users, access APIs, webhooks, and price widgets.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Service. These Terms apply to all users, including retail (B2C) and corporate (B2B) users, whether registered or unregistered.

1. Eligibility

  • You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older.
  • You must comply with all applicable laws and regulations in your jurisdiction when using the Service.

2. Account Registration

  • Optional Registration: You may use basic features, such as viewing real-time prices, without creating an account. To access advanced features (e.g., portfolio tracking, custom notifications, or event creation), you must create an account by providing a username, email address, and, optionally, a phone number.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at support@handy.markets if you suspect unauthorized access.
  • Accurate Information: You agree to provide accurate, current, and complete information during registration and to update it as necessary.

3. Use of the Service

3.1 Permitted Use

You may use the Service to:

  • Track prices of cryptocurrencies, fiat currencies, stocks, bonds, ETFs and commodities.
  • Set up notifications for price conditions (e.g., Crossing, Greater Than, Moving Up %) via channels like in-app, email, PUSH, Telegram, Discord, Slack, Webhook, SMS, or audio alerts.
  • Create, register for, or participate in financial events (e.g., seminars, conferences, token listings), subject to moderation for user-created events.
  • For corporate users, access APIs, webhooks, or price widgets for integration into third-party platforms.

3.2 Prohibited Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose or in violation of applicable laws.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems.
  • Use automated scripts, bots, or other tools to scrape data, overload the Service, or disrupt its functionality.
  • Post or share content that is defamatory, obscene, threatening, or otherwise harmful, including in user-created events or public profiles.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Misrepresent your identity or provide false information.
  • Interfere with or disrupt the Service, including by introducing viruses or malicious code.

4. Subscriptions and Payments

  • Paid Features: Certain features, such as advanced notifications or API access, require a paid subscription.
  • Payment Processing: Payments are processed by third-party providers. You agree to provide accurate billing information and authorize us to charge your chosen payment method.
  • Refunds and Cancellations: Subscription fees are non-refundable, except as required by law. You may cancel your subscription at any time, but no refunds will be issued for partial billing periods unless specified otherwise.

5. User Content

  • User-Created Events: You may create financial events (e.g., seminars or listings), which are subject to moderation. Approved events may be publicly visible and indexed by search engines.
  • Public Profiles: Information you provide in your public profile (e.g., username, profile picture, social media links) may be visible to other users or third parties.
  • License: By submitting content (e.g., events, profile details), you grant Handy.Markets a worldwide, non-exclusive, royalty-free, perpetual license to use, display, reproduce, and distribute the content for the purpose of operating and promoting the Service.
  • Responsibility: You are solely responsible for the content you submit and warrant that it does not violate any third-party rights or applicable laws.

6. Intellectual Property

  • Ownership: The Service, including its design, code, and content (excluding user content), is owned by Handy.Markets or its licensors and is protected by copyright, trademark, and other intellectual property laws.

8. B2B Services

  • APIs and Webhooks: Corporate users may access APIs or webhooks for real-time price data or notifications.
  • Price Widgets: You may embed price widgets on your websites, subject to our guidelines and branding requirements.
  • Compliance: Corporate users must ensure their use of B2B services complies with applicable laws and does not overload or misuse our systems.

9. Termination

  • By You: You may stop using the Service or delete your account at any time via your account settings. Account deletion may take up to 30 days, during which you can cancel the request.
  • By Us: We may suspend or terminate your access to the Service if you violate these Terms, engage in prohibited activities, or for any other reason at our discretion.
  • Effect of Termination: Upon termination, your right to use the Service ends. Public content (e.g., events) may remain accessible, and we may retain certain data as required by law.

10. Disclaimers

  • No Financial Advice: The Service provides price tracking and notification tools but does not offer financial, investment, or trading advice. You are responsible for your financial decisions.
  • Accuracy of Data: We strive to provide accurate and real-time price data but do not guarantee its accuracy, completeness, or timeliness. Data delays or errors may occur.
  • Service Availability: The Service is provided \"as is\" and \"as available.\" We do not guarantee uninterrupted access or error-free operation.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Handy.Markets, its affiliates, and their respective officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claim related to the Service will not exceed the amount you paid us in the 12 months preceding the claim.
  • You agree to indemnify and hold Handy.Markets harmless from any claims, losses, or damages arising from your use of the Service or violation of these Terms.

12. Modifications to Terms
